1. Scope of Agreement

These Terms of Service ("Terms") govern all access to and use of the Pekko mobile application and its corresponding features, functions, and digital services (collectively, the "Service"), operated by SYNAI CO., LIMITED. References to "we," "us," and "our" refer to the service provider of Pekko.

Downloading, opening, or interacting with Pekko constitutes your confirmation that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you reject any provision listed here, you must stop using Pekko and uninstall the application.

2. Eligibility for Use

By using Pekko, you represent and warrant that:

  • You are at least eighteen years of age or have reached the legal age of majority in your jurisdiction of residence.
  • You have full legal capacity to enter into this binding user agreement.
  • You will not use our Service in violation of local, national, or international laws.

If you access Pekko on behalf of an organization, you confirm that you have authority to bind that organization under these Terms.

3. Service License Grant

We grant you a limited, non-exclusive, non-transferable, revocable personal license to install and run Pekko on your personal mobile device for your individual non-commercial or commercial creative purposes.

You may not reverse-engineer, decompile, or disassemble the App; copy, redistribute, rent, or resell any part of Pekko; or build derivative competing products based on our Service. We may adjust, modify, or discontinue part or all of the Service without prior notice, within reasonable business scope.

4. User Conduct and User-Created Content

You retain complete ownership of the photographs, pictures, and text prompts you submit to Pekko. By submitting content, you grant us the limited permission required to operate the Service, including encrypted transmission, temporary server storage, and AI computation processing strictly to fulfill your creation request.

You agree not to upload, input, or generate material that is unlawful, harassing, threatening, obscene, violent, infringes third-party copyright or portrait rights, or violates public order and good customs. We reserve the right to conduct content moderation and may restrict or terminate your access to the Service if you violate these usage rules.

5. In-App Purchases and Premium Subscriptions

Pekko may offer paid premium membership, one-time credit packs, and other paid digital goods. All billing procedures are managed by Google Play. Prices shown inside the App are subject to your regional store settings.

  • When you confirm a purchase, charges will be debited from your Google Play account.
  • Auto-renewing subscriptions will renew within 24 hours before the current billing cycle expires. You can modify or turn off auto-renewal in your Google Play account settings.
  • Subscribed privileges remain valid until the end of the current billing cycle after you disable auto-renewal.
  • Refund policy: if you encounter an issue that requires a refund, please contact us through our official email address and we will assist you.

6. Intellectual Property Rights

All trademarks, logos, program code, interface layouts, original algorithm designs, and built-in template resources belonging to Pekko remain our intellectual property or the property of our licensed partners. You obtain no ownership rights over those intellectual assets by using the App.

7. Disclaimer of Warranties

Pekko and its features are provided on an "as-is" and "as-available" basis. We make no express or implied warranties regarding uninterrupted or error-free Service performance. We are not liable for outcomes generated by AI creative functions, including content accuracy, style matching, or applicability to your specific use case.

8. Limitation of Liability

To the maximum extent permitted by applicable law, neither we nor our affiliates shall be responsible for indirect, incidental, or consequential damages arising from your use of or inability to use Pekko, including data loss, creative work loss, or business losses. This limitation will not apply where the law prohibits such exclusion.

9. Termination of Service Access

We have the right to suspend or close your access to Pekko, with or without advance notice, if you breach these Terms, violate legal requirements, or create potential risks to platform security. Upon termination, you lose entitlement to premium Service functions. Provisions that logically should survive termination shall remain effective.

10. Modification of Terms

We may update these Terms from time to time. The revised version takes effect once published within the App or on the corresponding policy webpage. Your continued use of Pekko constitutes acceptance of the updated Terms.
